GENERAL TERMS AND CONDITIONS OF SALE:

Please carefully read the General Terms and Conditions of Sale for our Products before accepting them.

These General Terms and Conditions of Sale (hereinafter “GTC”) are governed and interpreted in accordance with French law.

These GTC apply to sales made by the company VA/CA Atelier (hereinafter “Seller”): a simplified joint-stock company with a share capital of €4,000.

The registered office is located at 16 rue Philibert Gaillard, 69270 Couzon au Mont d’Or. For more information about the Seller, please refer to the details above.

The purchase of Products offered on the website www.vacaatelier.fr (hereinafter “Site”) is subject to the GTC.

Site:

The website allows you to order a selection of VA/CA Atelier brand Products online via the internet from the company VA/CA Atelier.

​

​

The Products:

​

VA/CA Atelier Products are exclusively intended for sale to end consumers, whether individuals or legal entities, excluding all resellers or intermediaries acting on behalf of resellers. Therefore, the customer declares that they are acting as an end consumer and has no intention of directly or indirectly reselling VA/CA Atelier Products for commercial purposes. This commitment is essential for VA/CA Atelier.

The customer certifies that they have the legal capacity to enter into the commitments provided herein.

VA/CA Atelier may update these GTC at any time.

 

You can always find the latest version of the applicable GTC by visiting the “General Terms and Conditions of Sale” section on the Site.

The sales contract between you and VA/CA Atelier will include the terms of your order and the general terms of sale applicable at the time of your purchase, which apply to the exclusion of all other general conditions or any other terms. 

​

For each purchase on the Site, you will be asked to accept these General Terms and Conditions of Sale (GTC), which are in effect on the date of placing your order. The GTC can be reviewed before each purchase. You will need to check the box ‘Accept the General Terms and Conditions of Sale,’ otherwise, you won’t be able to complete your purchase.

Intellectual Property:

​

The Site, along with all logos, illustrations, images, designs, prototypes, and manufacturing techniques displayed on the Site (whether registered or not), are and will remain the exclusive property of VA/CA Atelier. Any total or partial reproduction, modification, or use of these logos, illustrations, images, designs, prototypes, or manufacturing techniques for any purpose and on any medium without the express and prior consent of VA/CA Atelier is strictly prohibited. The same applies to all copyrights, designs, and patents that belong to VA/CA Atelier.

Product Availability:

​

Product offers are valid within the limits of available stock. At the time of order validation, there may be a discrepancy between the computationally available stock and the physically existing stock (for example, in the case of simultaneous orders of the same Product by multiple customers). The sale is therefore subject to the availability of Products in stock. Additionally, VA/CA Atelier reserves ownership of the Products until full payment is received, in accordance with the provisions of the ‘Reservation of Ownership’ article below. In the event of unavailability of a Product after placing your order, we will inform you by email or phone as soon as possible, offering you the option to either order another Product presented on the Site as a replacement or cancel your order. VA/CA Atelier assumes no responsibility in case of stock shortage or Product unavailability. VA/CA Atelier reserves the right to change the Products offered on the Site and/or by phone at any time and without prior notice.

Order placement:

​

The sales contract will be formed once we receive your order on our Site. We will proceed with shipping your Product, subject to the availability of the purchased Product and full payment.

​

VA/CA Atelier reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if VA/CA Atelier reasonably believes that the customer has violated the terms and conditions or engaged in fraudulent activity, or for any other legitimate reason.

​

After placing the order, no refunds or returns can be made for the sold Products, except in the case of an error on our part or unavailability of the Product (see “Product Availability” section above) or the use of your right of withdrawal (see “Terms and Withdrawal Deadlines” section below).

​

Once the order is confirmed and paid, you will receive an email listing the ordered Products, unit prices of the Products, as well as the total amount of the order and any other necessary details. If you believe you haven’t received it, check your “Spam” folder, and if not, send us an email at this address: vacaatelier.contact@gmail.com. We strive to send confirmations to you as quickly as possible. We will attach your invoice.

VA/CA Atelier cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products displayed on the Site.

Pricing and Payment:

​

All prices are displayed in Euros, including all taxes. Shipping fees will be applied in addition and indicated at the time of order placement. The Products are invoiced at the price indicated during your order, subject to availability.

​

All payments will be made by credit card.

​

​

Reservation of Ownership:

​

The ordered Products remain the property of VA/CA Atelier until full payment of the price.

​

The Seller will not be held responsible for risks of loss, theft, or damage related to the delivery of the Products to the address provided during the order, upon delivery of the Products to the delivery service.

​

​

Delivery:

​

In the case of orders to countries other than metropolitan France, you are the importer of the relevant Products. Customs duties or other local taxes, import duties, or state taxes may be applicable. These duties and amounts are not within the scope of VA/CA Atelier’s responsibility. They will be the responsibility of the customer, both in terms of declarations and payments to the competent authorities and organizations in their country. We recommend that you inquire about these aspects with your local authorities.

VA/CA Atelier will not be responsible for non-compliance with deadlines (delivery delays, impossibility of delivery, return of Products to VA/CA Atelier, etc.) resulting from erroneous and/or incomplete information provided by you for delivery and/or your absence at the time of delivery.

​

VA/CA Atelier will not be held responsible for any modifications to your delivery information made after your confirmed and dispatched order.

​

You must verify the conformity of the Products at the time of delivery and indicate any anomalies observed (such as an open package or damaged Product) in handwritten reservations accompanied by your signature. You can subsequently contact us at this email address: vacaatelier.contact@gmail.com to share your remarks. If the Product has arrived damaged, please report it using photos of the sealed packaging, as well as a photo of the Product once the packaging is opened. VA/CA Atelier reserves the right to make a decision regarding the resolution of this issue.

Withdrawal Terms and Deadlines:

​

You have a legal right of withdrawal that you can exercise under the conditions provided by Articles L221-18 and L221-20 of the Consumer Code, if you meet the conditions set out in these provisions, without having to justify reasons and without having to pay penalties. In case of non-compliance with the legal deadline, we reserve the right to proceed with or without the replacement of the Product. The Products must be in the condition in which you received them. However, return costs will be at your expense unless the return is due to an error on our part.

In this eventuality, an exchange based on availability or a refund of the price of the relevant Product will be offered to you. After contacting us via our email address vacaatelier.contact@gmail.com and providing photos proving the good condition of the Product, we will send you a return label for the Product.

​

The Product subject to an exchange and/or refund request must not have been used and/or suffered any damage.

​

Legal warranty of conformity and warranty against hidden defects (Articles L217-4 to L217-14 of the Consumer Code and Articles 1641 to 1648 of the Civil Code):

​

All our Products are carefully inspected before being sent to you. The Products sold by VA/CA Atelier are subject to the legal warranty conditions provided by Articles L217-4 to L217-14 of the Consumer Code and Articles 1641 to 1648 of the Civil Code, excluding all other warranties.

VA/CA Atelier will deliver a Product that complies with the contract and is free from conformity defects upon delivery, meaning that the Product will be fit for the usual purpose of a similar good and will have the characteristics described during the sale. The Product must be properly maintained in accordance with VA/CA Atelier’s recommendations and guidelines found in the “Product Care” section.

If the Product has been used and maintained correctly according to VA/CA Atelier’s recommendations and guidelines in the “Product Care” section, and if the Product has a conformity defect and/or a hidden defect as per Articles L217-4 to L217-14 of the Consumer Code and Articles 1641 to 1648 of the Civil Code, you can choose between repairing and replacing the Product unless one of these options is impossible or would result in a disproportionately high cost for VA/CA Atelier, in which case VA/CA Atelier may choose the other solution.

In all cases, it will be your responsibility to prove that you meet the warranty conditions. In the event of a conformity defect and hidden defects, you will need to return the Products to VA/CA Atelier by contacting us at this email address: vacaatelier.contact@gmail.com.

Responsibility:

VA/CA Atelier’s liability cannot be engaged in any case for damages that do not result directly from its compliance and quality obligations.
